The Handbook of Texas records that local residents had pushed through incorporation as the town of Hays by 1980, when it counted 286 people, and that the population then eased down to 251 in 1990 and 233 in 2000. The 2020 Census found 227 residents in 92 housing units; by July 1, 2025, the Census Bureau's estimate had reached 271. The Bureau's survey counts every home as a single-family detached house and puts the median year built at 1970, give or take 5 years.
Zoning keeps the pattern: the "A" Single-Family Residential district requires lots of at least 1 acre, 150 feet wide and 150 feet deep, with no mobile homes of any kind, and the City's 1982 building ordinance requires the front walls of a main house to be at least 75 percent masonry.
Wear that resurfacing covers
Spalling, where the surface flakes away, can start with poor finishing or curing, a bad mix, de-icing salts or freeze-thaw cycles, and the remedies are a color-matched patch, an overlay, or tear-out and replacement. The USDA soil survey maps about 48% of the land inside Hays's Census boundary as Rumple-Comfort, rubbly association on 1 to 8 percent slopes, about 26% as Medlin, warm-Eckrant association on 8 to 30 percent slopes, and about 12% as Tarpley clay on 1 to 3 percent slopes (approximate shares, worked out from the map). Eckrant, one of the soils named there, is very shallow to shallow over hard limestone, with bedrock 4 to 20 inches down.
According to the City's code, most of the city and its extraterritorial jurisdiction lie within the Edwards Aquifer Recharge Zone, and the City's 2024 water quality report says its drinking water comes from two Edwards Aquifer wells in Hays County, each at least 400 feet deep. The code counts driveways, sidewalks and impermeable concrete as impervious cover.
An overlay adds no new paving
Resurfacing goes on top of a slab that's already there, so it doesn't add to a lot's impervious cover; widening a drive or adding a patio does. The posted code gives two caps it doesn't reconcile: the zoning schedule allows 40% impervious cover in the "A" district, while the water-quality rules hold a single lot in the upland zone to 18 percent. Its definition of "development" includes paving, and the one carve-out, for a government body repaving a public street that's already paved, doesn't reach private driveways. Hays requires a permit for all driveways on new and existing homes. The application goes to the City Administrator with construction plans, the driveway has to meet the City's standards before it's built, and a fee may be charged. The Code Enforcement Officer processes building permit applications and inspects the work, and the Building Code says additions, alterations and repairs must meet the provisions for new construction unless the chapter says otherwise.
Nothing in the posted code says whether an overlay on an existing drive counts as driveway work, so ask the City before the job starts: the fee schedule doubles permit fees for any work begun before the permit is signed. That schedule, posted as a 2023 final draft, charges $0.20 per square foot, with a $40 minimum, for flatwork such as patios, decks and porches, and lists a $250.00 application fee for residential and commercial building permits.
Where a drive crosses the ditch
Driveways must not significantly block drainage in the side ditches, and must be designed so the flow from a 25-year storm runs no more than 12 inches deep over any part of the drive; culvert pipe may be corrugated metal or concrete. Where a drive crosses a side ditch to reach a city road, the code asks for material that's easily restored if damaged, because the City isn't responsible for damage to driveways when it repairs or improves the drainage.

For small holes and cracks, a filler does the job rather than a surface sealer. Epoxy filler is the usual choice on home flatwork for cracks no wider than 1/8 inch, sealant can fill cracks up to 1/4 inch, and at 1/2 inch and up, a foam backer rod goes in first. Larger holes and spalls are patched, and an overlay can then cover the repaired surface.
